What is a trademark?

A trademark is a word, letter, phrase, logo, label, numeral, colour, sign, signature or any combination of words, letters, labels, signatures that identify and distinguish the sources of goods of one party from those of others in the course of trade.

What are the requirements for trademark registration in Nigeria?

  • Respresentation of the trademark
  • Applicants' details
  • Simply signed Power of Attorney (No notorisation or Legalisation required)
  • Full range of goods or services covered by the trademark
  • Proirity information, if applicable

What is the procedure for trademark registration in Nigeria?

  • Carry out a preliminary search (not compulsory)
  • File application in the desired class(es)
  • Acknowledgment of filing is issued immeddiately
  • Letter of Acceptance is issued if the trademark is found registrable
  • The trademark is published in the trademark journal for 60 days
  • If there is no opposition during the 60 day period, the trademark certificate will be applied for and issued.

How long does it take to register a trademark application in Nigeria?

If there is no opposition to the registration of a trademark, it usually takes between 24 to 36 months to get the trademark certificate. However, once the Letter of Acceptance is issued 10 to 30 days after filing, this provides some measure of protection vis a vis similar applications filed thereafter.
