Alteration is permitted as long as it does not substantially affect the identity of the trademark?

Filing a trademark application in colour limits protection offered to the trademark in the colour or colours it was filed in. However, filing a trademark application in black & white offers wider protrection. A trademark filed in black & white is protected in all other colours.

In Nigeria, we do not require the original copy of the Power of Attorney. A scanned copy is sufficient.

A trademark is a word, letter, phrase, logo, label, numeral, colour, sign, signature or any combination of words, letters, labels, signatures that identify and distinguish the sources of goods of one party from those of others in the course of trade.

• Respresentation of the trademark; • Applicant's name, address and nationality; • A simply signed Power of Attorney (No notarisation or Legalisation required); • List of goods and/or services; • Details of prority claim (if applicable).

If there is no opposition to the registration of a trademark, it usually takes between 24 to 36 months to get the trademark certificate. However, once the Notice of Acceptance is issued 10 to 30 days after filing, this provides some measure of protection vis a vis similar applications filed thereafter.
